1. Acceptance of Terms

2. User Accounts and Business Listings

  • Accuracy: You are responsible for ensuring that all information provided for a business listing is accurate, current, and complete.

  • Account Security: You are responsible for maintaining the confidentiality of your account login details and for all activities that occur under your account.

  • Prohibited Content: You may not list businesses or services that are illegal, fraudulent, or involve prohibited items (e.g., weapons, regulated substances) under Kenyan law.

3. Use of Services

You agree not to:

  • Use the directory for spamming, harassment, or gathering user data without consent.

  • Impersonate any person or entity, including business owners in Nanyuki.

  • Attempt to bypass any security features or gain unauthorized access to our servers.

  • Use automated scripts or “scrapers” to extract data from the website.

4. Intellectual Property

  • Our Content: The Nanyuki Now logo, design, and original content are the property of Nanyuki now and are protected by copyright and trademark laws.

  • Your Content: By posting a business listing, you grant us a non-exclusive, royalty-free license to display, modify, and promote that content on our platform.

5. Payments and Featured Listings

  • Fees: Certain features, such as premium or featured listings, may require payment. All fees are non-refundable unless otherwise stated.

  • Modifications: We reserve the right to change our pricing at any time, with notice provided for recurring services.

  • Exceptions: Refunds or credits may be issued at our sole discretion in the following limited cases:

    • Technical Errors: If a technical failure on our part prevents your paid listing from appearing online for more than 72 consecutive hours.

    • Double Billing: If you were accidentally charged twice for the same service.

  • Change of Mind: We do not offer refunds if you decide to close your business, change your marketing strategy, or if your listing does not generate the number of leads you expected.

6. Limitation of Liability

  • “As Is” Basis: Nanyuki Now is provided as a directory service. We do not guarantee the quality or legality of the businesses listed.

  • No Warranty: We are not liable for any direct or indirect damages resulting from your use of the site or your interactions with businesses found through the directory.

7. Termination

We reserve the right to suspend or terminate your account and remove any listings at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or the Nanyuki community.

8. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts in Kenya.

9. Changes to Terms

We may update these Terms from time to time. Your continued use of the website following any changes constitutes your acceptance of the new Terms.
